Terms and Conditions

Welcome to Martin's Hive & Harvest here are the rules that keep our community buzzing harmoniously. Please read them carefully, just like a bee inspects a promising flower!

1. Acceptance of Hive Agreements:

By accessing or using our Honeycomb Hub and services, you signify your acceptance of these Hive Agreements. If you don't agree with any part of these rules, please refrain from landing on our digital flower patch. Your continued use means you're giving us the "queen's nod" of agreement.

2. Use of Our Honeycomb Hub:

  • Foraging Rights: You're welcome to explore our content and resources for personal, educational, and non-commercial purposes. Think of it as responsibly gathering pollen.
  • No Sticky Fingers (Intellectual Property): All content on our Honeycomb Hub, including text, graphics, logos, images, videos, and educational materials, is our "royal jelly" (intellectual property) or that of our licensors and is protected by copyright and other laws. You can't reproduce, distribute, or create derivative works without our express written permission – that's like trying to steal honey from a guarded hive!
  • Respect the Hive (User Conduct): When interacting with our Honeycomb Hub (e.g., leaving blog comments), please be respectful and avoid any behavior that could disrupt the hive's harmony. No stinging other users or spreading digital "pests" (viruses, spam, etc.).
  • Accuracy of Our Nectar (Content Accuracy): We strive to provide accurate and up-to-date information, like bees diligently collecting the best nectar. However, beekeeping and farmsteading are dynamic fields, and we can't guarantee that all content will always be perfectly accurate or complete. Use our information as a guide, but always exercise your own judgment and consult other reliable sources.

3. Our Offerings (Products and Educational Services):

  • Sweet Deals (Product Information): We aim to provide accurate descriptions and pricing for our beekeeping supplies, tools, bees (when available), and educational materials. However, like the unpredictable nature of a bee season, prices and availability can change without prior notice.
  • Learning the Waggle Dance (Educational Services): Our workshops, courses, and guides are designed to provide valuable knowledge and skills. However, the success of your beekeeping or farmsteading endeavors depends on many factors beyond our educational content, like your local environment, dedication, and the temperament of your bees!
  • Order Fulfillment: From Flower to Hive: When you place an order, we'll do our best to process it promptly and efficiently, like worker bees building comb. However, shipping times and availability of live bees can be subject to external factors (weather, bee health, carrier delays).

4. Payments and Financial Nectar:

  • The Price of Honey (Payment Terms): You agree to pay the prices listed for our products and services, along with any applicable taxes and shipping fees. Payment methods are specified at checkout.
  • No Free Honeycombs (Payment Authorization): By providing your payment information, you authorize us (or our trusted payment processors) to charge the applicable amount.
  • Cancellations and Returns: Sometimes the Swarm Moves On: Our cancellation and return policies are outlined separately on our Website. Please refer to those specific "hive rules" for details.

5. Limitation of Liability: When Things Don't Go According to the Flight Plan:

To the extent permitted by law, Martin's Hive & Harvest and its beekeepers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Honeycomb Hub or our products and services. This includes, but is not limited to, loss of profits, data, use, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Beekeeping and farmsteading involve inherent risks, and we are not responsible for any losses or damages you may incur in your own endeavors. 

6. Indemnification: Protecting the Hive:

You agree to indemnify and hold harmless Martin's Hive & Harvest and its beekeepers, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Hive Agreements or your use of our Honeycomb Hub and services. Think of it as helping us defend the hive from external threats. 

7. Governing Law: The Laws of Our Bee Yard:

These Hive Agreements shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Hive Agreements shall be exclusively brought in the state or federal courts located in Kansas. 

8. Changes to Our Hive Agreements:

Just like bees adapt to changing seasons, we may update these Hive Agreements from time to time to reflect changes in our practices or legal requirements. We will post any revisions on our Honeycomb Hub and update the "Effective Date." Your continued use of our Website and services after the posting of changes constitutes your acceptance of the revised Hive Agreements. So, keep an eye on these "hive updates"! 

9. Entire Agreement: The Whole Honeycomb:

These Hive Agreements constitute the entire agreement between you and Martin's Hive & Harvest regarding your use of our Honeycomb Hub and services, superseding any prior agreements or understandings.

You make information and services available to your customers, and your customers must follow your rules.

Return and Refund Policy


Cancellation of Services Policy ("Changing the Flight Plan") for Martin's Hive & Harvest

At Martin's Hive & Harvest, we understand that sometimes plans change, like a bee deciding to forage on a different flower. Here's our policy regarding the cancellation of our educational services:

  • Workshop Cancellations: 
    • If you need to cancel your registration for one of our "Buzzworthy Basics," "Hive Handbook," "Honey Harvest Helper," "Winter Wellness," or "Pest & Pathogen Patrol" workshops, please notify us as soon as possible.
    • Cancellations made 7 days or more before the scheduled workshop date will be eligible for a full refund or credit towards a future workshop.
    • Cancellations made within 7 days of the scheduled workshop date may be subject to a partial refund (50%) or no refund due to material preparation and limited class sizes (think of it as the hive already preparing the nectar for your visit).
    • If Martin's Hive & Harvest needs to cancel a workshop due to unforeseen circumstances (like a sudden swarm!), we will notify you promptly and offer a full refund or the option to reschedule.
  • On-Site Installation Assistance Cancellations: 
    • If you need to cancel or reschedule your on-site "Hive Setup" assistance, please provide us with at least 48 hours' notice.
    • Cancellations with less than 48 hours' notice may be subject to a cancellation fee of $25.00 to compensate our beekeeper for their scheduled time (their foraging trip to your location).
    • We understand that weather can be unpredictable (like a sudden downpour). We will work with you to reschedule if weather conditions make on-site assistance unsafe for the bees or our beekeeper.
  • In-Store Installation Guidance Cancellations:
    • If you need to cancel or reschedule your in-store "New Hive Orientation," please let us know at least 24 hours' in advance so we can accommodate other budding beekeepers.
  • Cancellation Requests: All cancellation requests must be submitted in writing via email to [Your Email Address] or by phone at [Your Phone Number].
     

Return Policy ("Returning to the Hive") for Martin's Hive & Harvest

We want you to be happy with your purchases from Martin's Hive & Harvest, just like a bee returning to a full honeycomb. Here's our policy for returning physical products:

  • Eligibility for Returns:
    • Most new, unused, and resalable items in their original packaging can be returned within 30 days of the original purchase date for a full refund or store credit. Think of this as having a reasonable time to inspect your new beekeeping gear.
    • Exceptions: The following items are generally not eligible for return (just like you can't un-harvest honey!): 
      • Live bees (nucs or packages) - the health and well-being of live animals are paramount.
      • Opened or used protective clothing (for hygiene reasons, to prevent the spread of any "hive diseases").
      • Opened or used honey extractors or other equipment that comes into direct contact with honey or hive products (for hygiene and food safety).
      • Educational materials (books, guides, digital downloads) unless there is a clear defect.
      • Gift certificates or gift cards.
      • Sale or clearance items (unless explicitly stated otherwise).
  • Return Process:
    • To initiate a return, please contact us within 30 days of the original purchase date via email at [Your Email Address] or by phone at [Your Phone Number] to request a Return Authorization (RA) number.
    • Please provide your order number, the item(s) you wish to return, and the reason for the return. 
    • Once your return is approved and you receive an RA number, carefully package the item(s) in their original packaging (if possible) and include a copy of your original invoice or packing slip. Clearly write the RA number on the outside of the package.
    • You are responsible for the return shipping costs unless the return is due to a defect in the product or an error on our part (like sending the wrong type of hive tool). 
    • We recommend using a trackable shipping method for returns, as we are not responsible for items lost or damaged in transit back to us.
  • Refunds/Store Credit:
    • Once we receive your returned item(s) and inspect them to ensure they meet our return criteria (unused, resalable, original packaging), we will process your refund or issue store credit within 7-10 business days.
    • Refunds will be issued to the original payment method used for the purchase.
    • Shipping costs are generally non-refundable unless the return is due to a defect or our error. 
  • Damaged or Defective Items: 
    • If you receive a damaged or defective item (like a cracked honey gate), please contact us within 7 days of receiving your order with photos of the damage or defect. We will work with you to find a suitable solution, such as a replacement or a refund.
